Ontario Extends Time for Virtual Meetings and Voting and also Orders Stay-at-Home

Since our announcement Iast October 6, 2020, we have all seen the third wave of COVID-19 hit along with the new variants that are infecting our communities at an alarming rate.In light of the significant increase in COVID-19 transmission, on April 7, 2010 the provincial government announced its third emergency stay-at-home order effective at 12:01 on April 8th. 

The order requires everyone to stay at home except for the defined essential purposes, such as pharmacies and grocery stores, outdoor exercise, health care services, etc.  The order also imposed a new moratorium on residential evictions until further notice.

The government also announced regulatory amendments that extends the deadline for condominium corporations to be able to hold virtual meetings and permit electronic voting without a bylaw.

Condominiums corporations can, up to and including December 31, 2021 to:  

  • hold virtual owners’ meetings, including Annual General Meetings (even in the absence of a bylaw);
  • permit electronic voting (even in the absence of a bylaw);
  • serve notices electronically (even on owners who have not expressly consented to electronic communication); and
  • hold virtual board meetings (even where not all directors have agreed).

Boards of Directors are encouraged to consult with their corporation's legal counsel respecting the impact of these emergency orders on their corporation, including the passing of a virtual meeting and voting by-law before December 31, 2021.
