COVID19 UPDATE
The Ontario Government announced new restrictions that came into effect on Thursday, April 8 at 12:01 a.m. to address the increasing number of COVID-19 infections across the province. The new restrictions include a Declaration of Emergency and a province wide Stay-at-Home Order.
Additional regulations were implemented on Saturday, April 17 at 12:01 a.m., including a new list of construction activities, projects and related services that are permitted under the new restrictions. These permitted construction activities include residential construction activities, projects, and related services. In addition, section 35 of the original regulations has not been changed and remains in force. It provides that maintenance, repair, and property management services that “manage and maintain the safety, security, sanitation and operation of institutional, commercial, industrial and residential properties and buildings” are permitted.
The fact that certain work may not be prohibited under the current restrictions does not mean that the work must proceed. Considering relevant factors, a board of directors may want to prohibit certain work that may not otherwise be prohibited by the regulations, and in such situations should seek the advice of the Corporation’s lawyers, as appropriate.
