Competition Bureau – Criminal Charges Laid

On March 29, 2021, the Federal Competition Bureau published a brief news release related to alleged bid rigging in GTA condominium refurbishments occurring between 2009 and 2014. The news release can be found here.

It is important to note that while criminal charges have been laid, the allegations are not yet proven. The CCI-T Legislative Committee wishes to ensure that our members are aware of the results of the Competition Bureau's investigation, as several of our members are likely potential victims of the alleged fraud and bid rigging. "The condominium corporations and the condominium owners who fund them are the alleged victims."

The four companies involved are TRI-CAN Contract Incorporated, JCO & Associates, LAR Condominium Refurbishment Specialists, and CPL Interiors Ltd.

Affected condominium corporations should already be aware of this issue, because in 2016 the Ontario Superior Court required 141 condo corporations to turn over records to the competition bureau (read more about this here). However, it is unclear if any condominium corporations received follow up information after they submitted their records. If you are unsure, review the records of the corporation between 2009 and 2014 to determine if any of the above companies participated in bids for an interior refurbishment, and/or any record of an order to produce records related to a refurbishment project from the Competition Bureau in 2016.

As well, a reminder that it is always important to ensure that appropriate tendering processes are followed for major repairs in your condominium corporation. When collecting quotes for any major project, it is advisable to use a professional to manage a fair tendering, or bid process.
