Condominium corporations are obliged to enforce compliance with their governing documents and the Condominium Act. Traditionally, enforcement would occur through two dispute resolution mechanisms, being mediation/arbitration and the courts. The Condominium Authority Tribunal (the “CAT”) has added an additional dispute resolution mechanism to the mix. During this session, you will hear about recent enforcement decisions through the courts and CAT and what the evolution and expansion of the CAT will mean for the future of enforcement.
